BREATHE DIVINITY — PRIVACY POLICY

Breathe Divinity LLC ("Breathe Divinity," "we," "us," or "our"), a California limited liability company, operates the Breathe Divinity online store and all related websites, communications, programs, and services (the "Services") from the United States. This Privacy Policy explains what personal information we collect, how we use and disclose it, the rights and choices you have under U.S. federal and state law, and how to get accessibility help. By using the Services, you acknowledge that you have read this Privacy Policy. If it conflicts with our Terms of Service regarding personal information, this Privacy Policy controls.

1. Information We Collect
Depending on how you use the Services, we collect:

  • Contact details: name, billing and shipping address, email address, and phone number.
  • Order information: products viewed, added to cart, purchased, or canceled; order history; and damage claims and exchanges.
  • Payment information: payment method, billing details, and transaction records. Card numbers are entered into and processed by our payment processors. We do not store full card numbers.
  • Account information: login credentials, preferences, and settings.
  • Communications: emails, chats, messages, support tickets, survey responses, reviews, and photos you send us, such as with a damage claim.
  • Device and usage information: IP address, browser and device type, approximate location based on IP address, pages viewed, referring links, and how you interact with the Services and our emails and texts.
  • Referral information: whether you arrived through an athlete or affiliate link or used an affiliate code.
  • Inferences: preferences drawn from the information above, such as products and sizes you are likely to want.

2. Where We Get It

  • From you, when you place an order, create an account, sign up for emails or texts, contact support, submit a claim, enter a promotion, or post a review.
  • Automatically, through cookies, pixels, and similar technologies when you use the Services.
  • From service providers that run parts of the Services for us, such as payment, shipping, fraud prevention, and customer support providers.
  • From partners and platforms, including social media and community platforms and our athlete and affiliate partners.

3. How We Use It

  • Orders: process payments, ship orders, send order and shipping updates, and handle damage claims and exchanges.
  • Services: run and improve the Services, maintain accounts, remember your preferences, and provide early access and member benefits.
  • Support: respond to your requests and resolve issues, including accessibility requests.
  • Marketing: send promotional emails and texts where permitted, run promotions, and show you relevant products on the Services and elsewhere. You can opt out at any time.
  • Fraud prevention and security: verify transactions, screen orders for fraud, including with automated tools that may flag or cancel suspicious orders, and protect our customers, systems, and business.
  • Payment disputes: respond to chargebacks and payment disputes, including by providing order, payment, shipping, delivery, and communication records to payment processors and card issuers.
  • Legal: comply with the law, respond to lawful requests, enforce our Terms of Service and policies, and establish, exercise, or defend legal claims.

4. Text Messages (SMS)
If you opt in to texts from Breathe Divinity, you agree to receive recurring automated marketing and informational messages at the number you provide. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help.

Mobile numbers, text message opt-in data, and consent are never sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes. We share mobile information only with service providers that operate our text program, solely to deliver messages to you.

5. Cookies and Similar Technologies
We and our service providers use cookies, pixels, and similar technologies to operate the store (for example, keeping items in your cart), remember preferences, measure performance, prevent fraud, and support marketing. Where required by law, we ask for your consent before using non-essential cookies. You can manage cookies through our cookie banner, the "Your Privacy Choices" page, and your browser settings. Blocking some cookies may affect how the Services work.

6. How We Share It
We disclose personal information in the following circumstances:

  • Service providers that perform services for us, including Shopify, payment processors, fulfillment and warehouse systems, customer support platforms, email and text message platforms, analytics providers, and fraud prevention services. They may use your information only to provide services to us.
  • Shipping carriers and customs authorities, to deliver your order. International orders include information required for customs clearance.
  • Payment processors, banks, and card networks, to process payments and resolve fraud investigations, chargebacks, and payment disputes.
  • Advertising and analytics partners, which may collect device and usage information through cookies and pixels (see Section 8).
  • Athlete and affiliate partners, limited to the information needed to credit referred sales and pay commissions.
  • Related companies under common ownership or control with Breathe Divinity.
  • At your direction, such as when you ask us to share information or use social media features or login integrations.
  • Legal and safety: to comply with law or legal process; enforce our Terms of Service and policies; protect the rights, property, and safety of Breathe Divinity, our customers, and others; and in connection with claims or litigation.
  • Business transfers: in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets.

7. Shopify
Our store is hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit is transmitted to and shared with Shopify and third parties that may be located in countries other than where you live. We use certain Shopify features that combine information about your interactions with our store with information from other merchants and Shopify. For those features, Shopify is responsible for processing your personal information, including responding to your requests to exercise your rights. 8. Targeted Advertising, Sales, and Sharing
We do not sell personal information for money. We allow advertising and analytics partners to collect device and usage information through cookies and pixels, which some state privacy laws treat as a "sale," "sharing," or "targeted advertising." In the past 12 months, the categories involved were identifiers (such as IP address and cookie IDs), commercial information (such as products viewed or purchased), and internet activity, disclosed to advertising networks, social media platforms, and analytics providers.

To opt out, use the Your Privacy Choices link in our website footer. Depending on your state of residence, we treat a Global Privacy Control (GPC) signal as a request to opt out for the browser or device that sends it, and for your account if we can associate it. We do not respond to other "Do Not Track" signals.

We do not have actual knowledge that we sell or share the personal information of consumers under 16.

9. Sensitive Personal Information
Account login credentials and payment card information are considered "sensitive" under some state laws. We use them only to provide the Services, process payments, secure accounts, and prevent fraud. We do not use sensitive personal information to infer characteristics about you, and we do not sell or share it.

10. How Long We Keep It
We keep personal information only as long as reasonably necessary for the purposes in this policy. Retention is based on:

  • how long we need it to fulfill orders, provide support, and maintain your account;
  • tax, accounting, and other legal record-keeping requirements;
  • the time needed to resolve claims, chargebacks, and disputes and to enforce our terms; and
  • for marketing, until you opt out or the information is no longer needed.

When information is no longer needed, we delete or de-identify it.

11. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Keep your account credentials confidential, and do not send sensitive information, such as full card numbers, by email, chat, or text.

12. Your U.S. State Privacy Rights
Depending on your state of residence, you may have the right to:

  • Access / Know the personal information we hold about you and how we use and disclose it;
  • Delete personal information we hold about you;
  • Correct inaccurate personal information;
  • Portability: receive a copy of your personal information in a usable format;
  • Opt out of the sale or sharing of personal information and of targeted advertising (see Section 8);
  • Limit the use of sensitive personal information (we already limit it as described in Section 9).

Marketing: Unsubscribe from emails using the link in any email, or reply STOP to any text. We may still send non-promotional messages about your orders and account.

These rights are not absolute. We may keep information when the law allows or requires it, for example to complete an order, prevent fraud, or resolve a pending dispute.

How to submit a request: Email support@breathedivinity.com with the subject line "Privacy Request." We verify your identity by matching information you provide, such as your email address and order details, against our records. An authorized agent may submit a request with proof of your written authorization; we may still ask you to verify your identity directly. We respond within the time required by law.

Appeals: If we decline your request, you may appeal by replying to our decision with the subject line "Privacy Appeal." If you disagree with the outcome of your appeal, you may contact your state attorney general.

No discrimination: We will not deny you goods, charge you a different price, or provide a different level of service because you exercised your privacy rights, except as permitted by law for the programs described in Section 13.

Nevada residents: You may submit a request to opt out of the sale of covered information by emailing support@breathedivinity.com with the subject line "Nevada Opt-Out."

13. California Residents
This section supplements this policy and serves as our notice at collection under the California Consumer Privacy Act (CCPA).

Categories collected in the past 12 months: identifiers (name, address, email, phone number, IP address, account name); customer records (billing and payment information); commercial information (products viewed and purchased, order and claim history); internet or network activity; approximate geolocation; visual information (photos you submit); inferences; and sensitive personal information (account login credentials and payment card information). Sources, purposes, and recipients are described in Sections 2, 3, and 6. Only the categories listed in Section 8 are sold or shared. Retention criteria are in Section 10.

Notice of Financial Incentive: We may offer discounts, free shipping, early access, or other benefits when you join our email list, text list, or VIP programs. The terms of each offer are shown at sign-up. Joining is voluntary. You opt in by submitting your email address or phone number, and you may withdraw at any time by unsubscribing from emails or replying STOP to texts. We estimate the value of the personal information you provide to be equal to the value of the benefit offered, calculated from our cost to provide it. The benefit is reasonably related to the value of that information.

Shine the Light: California residents may request information about our disclosure of personal information to third parties for their own direct marketing purposes by emailing support@breathedivinity.com.

14. Children
The Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, contact us and we will delete it. If you are under 18, use the Services with the involvement of a parent or guardian.

15. Third-Party Sites and Platforms
The Services link to third-party websites and platforms, including social media and our Discord community. Their privacy practices are governed by their own policies, not this one. Content you post publicly, including reviews, comments, and messages in community channels, may be visible to others.

16. Customers Outside the United States
The Services are operated from the United States, and your information is processed in the United States and other countries where we and our service providers operate, where privacy laws may differ from those where you live. If the laws of your country give you additional rights over your personal information, you may exercise them by emailing support@breathedivinity.com, and you may have the right to lodge a complaint with your local data protection authority. Where required, we rely on recognized transfer mechanisms such as Standard Contractual Clauses.

17. Accessibility
We want every customer to be able to shop the Services, including customers who use screen readers, keyboard navigation, magnification, or other assistive technology. We are working toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA.

Get help: If any part of the Services is difficult to access or use, email breathedivinity@gmail.com with the page and the issue. We will respond promptly, provide the information you need in an alternative format, and help you complete your order directly if needed. This policy is also available in alternative formats, such as large print or plain text, on request.

Third-party features: Checkout, payments, text message sign-up, reviews, and community platforms are provided by third parties. We do not control their code, but we raise accessibility issues with those providers when they affect our customers.

18. Disputes
Any dispute relating to this policy or your personal information is subject to our Terms of Service, including its dispute resolution provisions, except where prohibited by law.

19. Changes to This Policy
We may update this policy from time to time. We will post the updated version on this page and change the "Last updated" date. For material changes, we will provide notice as required by law.
